Sore Pak Imam, Mohon pencerahan, Apakah polis ICC cover “rats and vermin” . Di MIA 1906 jelas diexclude, namun di ICC A tidak ada di exclusion. Apakah ini berarti rats dicover di polis allrisk ICC A, dan vermin apabila datang dari luar. Dan tidak dicover untuk vermin yang sudah ada didalam cargo tsb (misal : vermin sudah bertelur di dalam kopra) sebelum shipment. Bagaimana menurut pak Imam ? As far as ICC (A) is concerned, so long as the vermin originated from ‘outside’ of the cargo the resultant claim is payable.

Coming now to ICC (B) and (C)-the “name perils” version, there is no mention of vermin etc in the list of insured perils. However if there is say an ingress of water in the hold etc (ICC B-Peril) and in that environment vermin arrive and thrive, I am sure loss “reasonably attributable” rule might kick in favour of the claimant.

Kerusakan atau kerugian akibat “rats and vermin” di exclude di MIA karena saat MIA di buat (1906), risiko ini adalah inevitable dimana saat itu, kebanyakan kapal-kapal niaga menjadi sarang tikus, juga komoditi-komoditi yang dikirim belum mengalami proses fumigasi seperti saat ini.

The Institute Cargo Clauses (ICC) , yg notabene keluar 1982, dibuat saat bisnis pelayaran berkembang, dan walaupun tetap mengacu ke MIA, tapi tanpa mengecualikan resiko ini, mungkin menganggap bahwa “rats and vermin” bukan risiko yang inevitable, tapi benar-benar risiko murni.

“if rats orvermin attack the goods from an outside source during the course of transit covered

by an “all risks” policy, the resultant damage would be recoverable. But, if cargo is infected by insects or grubs, which are inherent in the cargo, there is clearly no liability under the policy for such infestation. There would similarly be no liability under the policy if cargo is infested by insects or grubs, which, although not indigenous to the particular type of cargo, were actually in that cargo prior to inception of the transit risk insured”

Namun, jika “rats and vermin” berasal dari atau sudah ada di dalam kargo sebelum “transit” maka tentu saja tidak dijamin
