  Dear Pak Imam,

  Ada polis Marine Cargo dimana didalamnya terdapat klausula Brand and Label Clause, dimana barang yang diasuransikan mengalami kerusakan, namun tidak mengalami kerusakan untuk keseluruhan jika dicek secara kasat mata. Namun pihak Insured defens tidak mau lagi menggunakan barang tersebut, dan akan memusnahkannya. Dan biaya pemusnahan diklaim ke Asuransi.
  Apakah biaya tersebut dapat dibebankan ke Asuransi?

  Asuransi bayar klaim sesuai “harga invoice”, Pak. (khan barang-nya rusak). “Brand and Label Clause” pada prakteknya menyebabkan asuransi kehilangan harga salvage value karena barangnya harus dimusnahkan karena menyangkut “brand and image”. Biaya pemusnahan adalah beban klien (khan asuransi sudah bayar klaim seharga invoice-nya)

  – dalam polis land transit cover B apa saja yang dijamin dan yg dikecualikan?
  – dalam ikhtisar pertanggungan INLAND TRANSIT bolehkah diberi  catatan : excluding scratching,Denting,Bending?
  – adakah contoh klausul INLAND COVER B?

  DAI Inland Transit Cover A atau B seharusnya sudah tidak dipakai lagi, DAI sendiri sudah tidak mengurusi operasional asuransi umum, AAUI yang mengurusi sekarang sudah mengeluarkan PSAPBI, seharusnya yang digunakan adalah PSAPBI atau ICC

  Dear Pak Imam,

  mohon pencerahannya, pada klausul marine cargo tertulis :

  “Limit of Liability : Domestic : USD. 1,000,000.00 anyone shipment”

  apakah ini maksudnya limit tertanggung sebesar $ 1.000.000 untuk setiap pengiriman (per vehicle)?

  atau $ 1.000.000,- total pengiriman di hari tersebut ?

  Per pengiriman
  harusnya tulisan lengkapnya any one shipment any one conveyance
  berlaku per pengiriman per satu alat angkut (truck atau kapal)

  Hal2 apa yang memperbesar risikonya ?

  Sama saja dengan kargo lainnya
  Pengangkutan tembakau sangat rentan dengan:
  1. Hijacking, pencurian, perampasan, baik dari pihak luar atau dalam, termasuk banyak kasus yang melibatkan supir sehingga perlu diperhatikan:
  a) Kualitas dari freight forwarders atau angkutan ekspedisinya
  b) Security, seperti pengawalan, GPS stc
  2. Harus kontainerized, kalo tidak ya rentan basah
  3. Perhatikan loss ratio nya, kalo sering kena hijack/perampokan mending ngga usah cover
