Apa perbedaan antara Public Liability v Product Liability ?

To answer this question, it must first be understood that the basic covers for public liability and product liability insurance are the same in that they both provide protection for amounts you (the insured party) may become legally liable to pay for compensation (damages), in respect of third party (other persons) personal injury or property damage, as a result of an occurrence in connection with your business.

Pertama perlu dipahami bahwa baik Public Liability & Product Liability menjamin tanggung jawab hukum tertanggung terhadap pihak ketiga baik berupa cidera badan (personal injury) maupun kerugian harta benda (property damage) sebagai akibat suatu kejadian sehubungan dengan bisnis atau pekerjaan yang diasuransikan.

Termasuk menjamin biaya-biaya hukum sehubungan dengan klaim tersebut (legal cost and expenses)

Lalu apa perbedaanya?

Public Liability Insurance Policy is designed to protect the insured in respect of his legal liability to pay compensation for accidental bodily injury or accidental damage to the property of the other person caused by or through the negligence of the insured or his employees or by any defect in the premises owned or any defects in the ways, works of the insured. In addition, the Policy also pays for the litigation costs and expenses for defense that are incurred with the written consent of the Company.

Product Liability Insurance is designed to indemnify the manufacturer or supplier of the ‘defective’ product against losses resulting in bodily injury or property damage arising from the use of the ‘defective’ product. It also pays for the litigation costs and expenses incurred in the defence of a suit provided prior written consent of the Insurance Company is first obtained.

Klaim Public Liability umumnya terjadi akibat “negligence” dari tertanggung, atau pegawai atau karena penggunaan bangunan atau bagian bangunan (premises), mesin-mesin, peralatan atau karena pekerjaan (bisnis) yang sedang dikerjakan.

Klaim Product Liability umumnya terjadi akibat

  1. Design Defect
  2. Manufacturing Defect
  3. Marketing Misrepresentation

Klaim Public Liability umumnya terjadi dilingkungan pekerjaan (premises) dimana kegiatan bisnis berlangsung. Sedangkan Product Liability adalah akibat penggunaan produk oleh pengguna / konsumen akhir (di luar premises tertanggung)

Klaim Public Liability umumnya adalah satu peristiwa tertentu (single event) sehingga dapat segera dilakukan perbaikan (remedial action). Sedangkan Product Liability umumnya melibatkan rangkaian atau banyak kejadian (series of events) dan langkah perbaikan umumnya dapat menyebabkan penarikan produk dari pasaran (product recall) dengan biaya yang sangat besar.

Public Liability umumnya bersifat “Occurrence Basis” sedangkan Product Liability umumnya adalah “Claims Made Basis”.

However the significant dierence between the two is that public liability insurance provides cover for occurrences that happen whilst your works are actually being performed and products liability provides cover for occurrences that happen after the works have been completed and handed over.

    Dear Pak Imam,

    Saya ada case dengan property insurance.
    tahun 2013, mereka issued Polis untuk waktu pertanggungan Jan 13-Dec13
    Nah, untuk masa pertanggungan Jan 14-Dec14, mereka issued polis di Feb 2015.
    Apakah saya harus membayar premi (tagihannya terbit maret 2015) ?

    YA tentu anda harus membayar premi tersebut
    karena polisnya khan sah, walaupun baru dikirim bulan Maret
    (kecuali anda berniat untuk membatalkannya karena terlalu lama terima polisnya)
    (Beberapa perusahaan asuransi memang sering terlambat dalam menerbitkan polis (juga tagihan premi)

    Mau sharing pak imam, kalo ada permintaan tertanggung spt ini contoh, pemilik kafe atau pub atau diskotik minta polis yang menjamin keusakan material miliknya spt gelas, meja, kursi akibat perbuatan yg tiba2 dan tidak disengaja dari pengunjung. Case ini menurut pak imam paling tepat masuk ke dalam polis apa pak? Serta mohon diberiakan indikasi tc dan ratenya. Makasih.

    Hhm masuk dipolis apa ya? kalo pengunjug jatuhin atau lempar gelas? sundut rokok di sofa, etc…
    (pasti perusahaan asuransinya ngga mau jamin kerusakan yang seperti ini, atau ada yang mau jamin? silakan.)
