Apakah “Loading-Unloading” dijamin di ICC 1/1/82 (Institute Cargo Clauses 1/1/82)?

Pertanyaan yang selama ini menjadi perdebatan dikalangan praktisi asuransi marine cargo, Apakah “Loading-Unloading” dijamin di ICC 1/1/82 (Institute Cargo Clauses 1/1/82)? banyak kalangan yang bependapat tidak dijamin berdasarkan bunyi “Transit Clause”.

 

“This insurance attaches from the time the goods leave the warehouse…”

 

“and terminates either… on delivery to the Consignees’ or other final warehouse…”

 

Kebingungan selanjutnya bagi “Tertanggung” maupun “Penanggung” adalah:

1.             Apa yang dimaksud “meninggalkan gudang”? apakah saat ban truk trailer pertama kali bergerak? atau bergerak meninggalkan pintu pagar (gate)? Bagaimana kalau jarak gudang ke pintu keluar (gate) sangat jauh? Dan seterusnya?

2.             Bagaimana dengan kontainer yang menginap? Karena “kemaleman” misalnya sehingga setelah loading tidak bias langsung ke “Tanjung Priok” dan harus menginap semalaman di tempat parkir di gudang / pabrik?

3.             Atau karena kontainer datang “kemaleman” atau pada “hari libur” sehingga tidak dapat segera di “unloading”?

4.             Bagaimana kalau terjadi “kebakaran, banjir, atau pencurian” pada saat-saat tersebut?

5.             Apakah kargo yang “jatuh, tersodok forklift, atau rusak” saat “bongkar-muat” tersebut dijamin?

 

Sebagian klien atau broker yang “pinter” men-“siasatinya” dengan “additional clauses” yang kadang kala “wordings” nya pun membingungkan seperi “Loading and Unloading Clauses”

 

Keruwetan-keruwetan inilah yang memicu para “ahli” menerbitkan versi baru yaitu “Institute Cargo Clauses 1/1/2009”

DURATION

8. 8.1       This insurance attaches from the time the goods leave the warehouse or place of storage at the place named herein for the commencement of the transit, continues during the ordinary course of transit and terminates either

8.1.1        on delivery to the Consignees’ or other final warehouse or place of storage at the destination named herein

8.1.2        on delivery to any other warehouse or place of storage, whether prior to or at the destination named herein, which the Assured elect to use either

8.1.2.1     for storage other than in the ordinary course of transit or

8.1.2.2     for allocation or distribution, or

8.1.3        on the expiry of 60 days after completion of discharge overside of the goods hereby insured from the oversea vessel at the final port of discharge, whichever shall first occur.

8. 8.1          Subject to Clause 11 below, this insurance attaches from the time the subject-matter insured is first moved in the warehouse or at the place of storage (at the place named in the contract of insurance) for the purpose of the immediate loading into or onto the carrying vehicle or other conveyance for the commencement of transit, continues during the ordinary course of transit and terminates either

8.1.1        on completion of unloading from the carrying vehicle or other conveyance in or at the final warehouse or place of storage at the destination named in the contract of insurance,

8.1.2        on completion of unloading from the carrying vehicle or other conveyance in or at any other warehouse or place of storage, whether prior to or at the destination named in the contract of insurance, which the Assured or their employees elect to use either for storage other than in the ordinary course of transit or for allocation or distribution, or

8.1.3        when the Assured or their employees elect to use any carrying vehicle or other conveyance or any container for storage other than in the ordinary course of transit or

8.1.4        on the expiry of 60 days after completion of discharge overside of the subject-matter insured from the oversea vessel at the final port of discharge, whichever first occur.

 

 

Dengan versi baru “Institute Cargo Clauses 1/1/2009” tidak ada lagi “kontroversi” mengenai “Transit Clause”

 

“This insurance attaches from the time the goods leave the warehouse…”

 

diganti dengan:

 

“this insurance attaches from the time the subject-matter insured is first moved in the warehouse or at the place of storage (at the place named in the contract of insurance) for the purpose of the immediate loading into or onto the carrying vehicle or other conveyance for the commencement of transit,…”

 

“and terminates either… on delivery to the Consignees’ or other final warehouse…”

 

diganti dengan:

 

“and terminates either…on completion of unloading from the carrying vehicle or other conveyance in or at the final warehouse…”

 

 

Lalu mengapa anda masih menggunakan versi lama  “Institute Cargo Clauses 1/1/82”??

 

(a)           Karena tidak tahu

(b)           Karena sudah lama sekali menggunakan ICC 1/1/82 dan tidak mau berubah?

(c)           Karena males saja karena kalau menggunakan versi baru ICC 1/1/09 berarti harus baca, belajar wordings lagi, dan harus jelasin lagi ke klien, capek deh…ha..ha..

    Sebenarnya dalam ICC 1/1/82 kerugian yang terjadi selama dalam proses “loading” dan/atau “unloading” sudah jelas tidak terjamin, karena “duration” dalam polis ICC 1/10/82 menganut kaidah “the movement of the goods through the warehouse door (rather than the loading of the goods aboard the carrying vehicle)”.

    mas imam,

    apakah kita bisa mengecualikan risiko loading dan unloding khususnya atas barang-barang yang sangat rawan terhadap proses loading / unloading.
    misalnya dengan ICC”A” excluding loading and unloading.
    apakah ada warranty atau klausula khusus untuk itu.

    Pak Edith, dalam ICC 1/1/82 (A/B/C) tidak menjamin risiko selama dalam proses “loading/unloading” jadi tidak perlu pencantuman warranty itu.

    Justru yang terjadi sebaliknya, bagi tertanggung yang menginginkan agar risiko selama “loading/unloading” terjamin dalam ICC 1/1/82 (A/B/C) harus minta & dilekatkan “loading & unloading clause”

    pak imam, mohon maaf menyimpang dari masalah cargo ins, ” sy bertanya soal HE; (ALAT BERAT) : PERTANYAANNYA : APAKAH PADA SAAT DI TEST TERUS TERJADI KERUSAKAN DIJAMIN PADA POLIS HE (POLIS HE MENUTUP OBJEK HE BRAND NEW CONDITION).
    SY PUNYA KASUS : HE  BARU DIKIRIM DARI DEALER,KELOKASI PROYEK ,  DILOKASI PROYEK DI TEST DARI TEAM DEALER DGN PEMBELI(TERTANGGUNG), TERUS MENGALAMI MUSIBAH.

    Selengkapnya keterangan di Polis CPM (Munich Re) sbb:
    This Policy shall apply whether the insured items are at work or at rest,or being dismantled for the purpose of cleaning or overhauling, or in the course of the aforesaid operations themselves, or in the course of subsequent re-erection, but in any case only after successful commissioning.

    Polis CPM tidak menjamin “Pengetesan” (baca: pemasangan dan pengetesan karena harus beli polis EAR).

    menurut saya dalam kasus di atas harusnya masih dalam “Manufacturer’s Guarantee” (jika kesalahan pabrikan) atau dalam jaminan Polis EAR (jika terjadi kesalahan instalasi / pemasangan)
