AVERAGE RELIEF CLAUSE (85%)

Whenever A Sum Insured is declared to be subject to the special condition of average, then, if such sum insured shall be at the breaking out of any fire or at the commencement of any destruction of or damage to the property by any other peril hereby insured against, be less than 85 % of the value of the property insured in that amount the insured shall be considered as being his own insurer for the difference between the sum insured and the full value of the property insured at the time of the fire or at the commencement of such destruction or damage and shall bear a rateable share of the loss accordingly.

untuk average relief clause ini supaya lebih jelas, bisa Pak Imam tolong berikan contoh dalam hal perhitungan pembayaran klaimnya.

Applikasi Average Relief Clause (85%)
Contoh : TSI : $850,000; VAR : $1,000,000; Claim $100,000
Dengan Average Relief Clause (85%) maka claim payable $100,000
Tanpa Average Relief Clause (85%) maka claim payable $85,000

Dear Pak Imam,

dari seluruh “Average Relief Clause (85%) yang Bapak cantumkan disini, saya membaca “be less than 85 % of the value of the property insured in that amount the insured shall be considered as being his own insurer for the difference between the sum insured and the full value of the property insured at the time of the fire or at the commencement of such destruction or damage and shall bear a rateable share of the loss accordingly.” Apabila kalimat tersebut hanya berhenti sampai di situ, maka apabila harga pertanggungan kurang dari 85% maka Tertanggung akan menanggung sendiri selisih antara uang pertanggungan dan jumlah yang merupakan biaya untuk mengembalikan seluruh properti dan akan menanggung proporsi kerugian, sehingga tujuan dari “Average Relief Clause” tersebut untuk melindungi Tertanggung dari perhitungan prorate TIDAK TERCAPAI. Oleh karenanya klausula ini harus di lengkapi dengan kalimat “The insured shall not be considered as being under insured if the sum insured is eighty five (85) per cent or more of the reinstatement cost.” sebagai tambahan paragraf baru.

Menurut saya arti kalimat-nya sama
yang satu bilang kalo kurang dari 85% berlaku prorata (artinya kalo 85% atau lebih tidak prorata)

saya mau diskusi sedikit.
– Apakah ada mekanisme interpretasi dari sisi hukum, dimana kalau kita menyebutkan sesuatu kondisi secara tertulis maka secara logika opposite-nya berlaku juga?

Contoh : if less than 85% would be under insured.
opposite -nya : if more than 85% wouldn’t be under insured

Hal ini sering dipahami demikian di pasar atas wording2 clauses yang beredar. Kalau begitu menurut kami kondsinya cukup rawan menimbulkan dispute di pengadilan.

Kaidah bahasa memanglah demikian:
Jika kurang dari 85% berlaku under-insurance, MAKA lebih dari 85% tidak berlaku under-insurance
